How does my family get access to my Will after I die?

If you've notified the important people in your life through the notifications function on your dashboard, they'll be told that your Will was completed through Footprint. You're responsible for keeping the signed original Will in a safe place. Make sure the people you notify also know exactly where you've chosen to keep it, so they can find it when the time comes.

How do I cancel my subscription?

You can cancel your subscription to Footprint at any time from the account section in your dashboard. If you choose to cancel your subscription part way through the year, no refunds will be provided, except where required under the Australian Consumer Law. You do however still have full access to all benefits and features included in your subscription until the end of the year. Alternatively, you can email us at info@footprintwill.com.au to cancel at any time.

Can my executor also be a beneficiary in my Will?

Yes, your executor can also be a beneficiary of your Will. This is common and completely legal. If you think there could be disagreements between your beneficiaries, you might consider appointing an independent executor to avoid any potential conflict of interest when your estate is being administered. It’s entirely your call.

What happens if the beneficiaries of my Will are under the age of 18 years old?

In Australia, anyone under 18 can’t receive an inheritance directly. If you leave a gift to someone under 18 (for example, grandchildren, nieces or nephews), it will be held in trust by the trustee of your Will until they turn 18, or a later age if your Will says so. The trustee can usually use the funds before then for the child’s maintenance, education, advancement or benefit.

Can my partner and I have one Will between us?

Joint Wills are common overseas. Joint Wills carry a higher risk of being disputed because a Will is treated as an individual expression of wishes; many people choose separate Wills for this reason. That being said, nothing stops you from writing your Wills together to reiterate the same wishes and essentially mirroring your spouse’s Will, or vice versa.

Can I incorporate my overseas assets in my online Will?

Every country has its own set of rules and legislation, and having your executor deal with these from here in Australia can increase time and costs. People often look to create a separate Will in the country of origin for any overseas assets. This can help keep the $$$ down and should speed up the process.

How do I sign my Footprint Will correctly?

Once you have completed your Will, it will be sent back, and you will be advised to log in to your Footprint account to review its contents. You can then download a copy, print it single-sided, and sign it. Signing your Will requires two witnesses who are not named in your Will and who are over the age of 18. You and your witnesses will need to sign each page. Following the instructions exactly is super important as missing a step can actually make your Will invalid, crazy we know but that's the rule. What is a good age to write a Will?

Legally you can’t get a Will until you are 18 however it’s less about age and more about the value of your assets (AKA stuff) and or at what point you get hitched or have your own ankle biters (AKA children).

As soon as you start to build assets, you need a Will in order for those assets to go to the people you want them to go to. This could be one item or a combination of items like your car, savings and personal things you own.

A good age or time to write your Will largely depends on your individual circumstance and the assets you possess. If you don't have a Will, intestate laws decide how your stuff will be distributed.
